This rental agreement (this “Agreement”) is between you (the “Client”) and Creature Group Pte Ltd (“CC”). CC remains the sole owner of all its rental equipment. CC is not offering for sale, and the Client is not purchasing, the rental equipment. The Client hereby acknowledges that the rental equipment shall be for personal or corporate use only. By accepting the terms and conditions of this Agreement via checking/ticking the box or proceeding with the rental of the rental equipment, the Client acknowledges that it/he/she has read, understood and agree to the terms stated below.
Booking, Refundable Rental Deposit, and Payment of Rental Fees
The Client’s booking is attached hereto and incorporated by reference.
Payment is due via the relevant payment method stated on the City Creature website or mobile application. The refundable rental deposit (the “Rental Deposit”) will be collected at the same time the Client makes the booking for the rental equipment. The full amount of the Rental Deposit will be refunded to the Client when returning the rental equipment in working condition with no damaged or missing parts.
Refund of the Rental Deposit will be made via the same payment method that the Client used for the booking or any other payment method that CC decides in its sole discretion.
A substitute product will be provided in case the ordered product is out of stock.
Delivery, Possession, and Usage
At the time of booking, the Client will specify the location in Singapore where the rental equipment will be delivered and picked up for return by courier. The Client agrees to pay a service fee of SGD 30 per delivery or collection attempt. If “Delivery and Return pick up by courier” is selected by the Client, 48 hours prior notice from the Client to CC is required. CC will deduct additional fees up to a maximum of SGD 20 from the Rental Deposit if the Client choses the wrong delivery options.
The Client agrees to contact CC within 6 hours of the agreed delivery date and time by phone or email if the Client is unable to locate or take delivery of the rental equipment. The Client agrees and understands that all requests for changes to the existing booking must be made at least 24 hours before the agreed delivery time in the above booking. Change requests made less than 24 hours before the agreed delivery time shall be subject to the sole and absolute discretion of CC as to whether these change requests will be honoured by CC or not.
The Client agrees and understands that all deliveries are made with an earnest effort to the requested delivery time slot but, due to traffic or volume, understand there is a delay to the requested delivery time. The Client understands and agrees that during times of extreme weather, deliveries and/or pickups may be suspended for the safety of delivery personnel until such time it is deemed safe by management to continue operations.
The Client agrees that if no contact is made within 2 hours of the agreed delivery date and time, the Client accepts possession of the rental equipment and its responsibilities during the possession.
If an attempt is made to deliver the rental equipment to a location stated by the Client and the Client is unavailable or the Client has provided the incorrect delivery location resulting in a 2nd trip to redeliver, a SGD 30 re-delivery fee may be applied at CC’s sole and absolute discretion.
The Client agrees that it/he/she has made every effort to verify that the stated delivery location and location for return pick up by courier are within the stated delivery area (as stated in the FAQ section of the City Creature website) and that any booking may be altered or cancelled at any time at CC’s sole and absolute discretion if the desired location is not in the delivery area as stated.
The Client agrees that any booking may be altered or cancelled at CC’s sole discretion if CC deems the desired location’s health and safety standards to be detrimental to the nature of CC’s business.
The Client agrees to maintain possession of the rental equipment throughout the course of the rental period. Rental equipment are to be kept secure when not in use.
The Client agrees to inform CC immediately of any defect or malfunction while in use. Once notified, CC will make every effort to remedy the issue in a timely manner. Any report after 2 hours of delivery is considered damage done to the item by the Client. The Client will be responsible for replacement or repair cost of the item.
The Client agrees to only use the rental equipment for its intended purpose in a manner for which it was designed.
The Client agrees that violations of this Agreement may result in the termination of the rental. CC reserves the right to terminate a rental based on evidence of abuse or violation of all parts of this Agreement. The Client agrees to surrender all rental equipment and accessories to CC upon request from CC. CC may, at its sole discretion, refund any portion of a rental that it deems necessary to terminate.
The Client agrees that based on the request of the Client, any rental equipment exchange due to (but not limited to): rental equipment left in the rain, soiled or dirtied excessively in the sole and absolute view of CC – may be charged an minimum SGD 20 cleaning fee at CC’s sole and absolute discretion.
Returning rental equipment
It is the responsibility of the Client to ensure that all rental equipment are available for pick up for return by courier on the date and time slot specified in the booking. All rental equipment are to be returned to CC and/or its staff on the date of return.
If the Client wishes to extend the rental period the Client must contact CC before the agreed upon return time. CC may, at its sole and absolute discretion allow or deny any extension. CC reserves the right to charge the Client’s via his/her/its credit/debit card or any other payment method in CC’s sole and absolute discretion and the Client agrees to allow the charge of SGD 4.50 for each additional day or fraction of a day the rental equipment is kept by the Client.
Client agrees to contact CC in the event of a delay in returning the rental equipment at the agreed upon time. It is the sole and absolute discretion of CC as to whether a grace period may be granted. A SGD 30 fee may be applied for return trips to pick up rental equipment if not returned at the agreed upon time as listed in the booking or prearranged with CC.
The Client agrees to contact CC if the rental equipment is returned earlier than the agreed date of pick up for return by courier. Failure to notify CC will void any insurance taken on the rental equipment (if applicable).
In the event the returned rental equipment need special cleaning processes to remove stubborn stain (including without limitation soil, dirt, bodily fluid etc) – CC will charge an minimum SGD 20 cleaning fee at CC’s sole and absolute discretion and will deduct the same from the Rental Deposit.
Damages to or loss of rental equipment
The Client shall accept for use, as is, the rental equipment listed on the booking, and accept full responsibility for the care of the rental equipment while it is in the Client’s possession.
The Client is responsible to pay the full replacement value of any rental equipment rented under this Agreement that is not returned to CC within 72hrs of the end of this Agreement. The Client also agrees to authorize the replacement cost of each rental equipment by deduction from the Rental Deposit or to the Client’s credit card or any other payment method in the sole and absolute discretion of CC, if the rental equipment is not returned. If an item(s) has been recovered after the Client has been charged, a full refund of the replacement charge will be issued to the Client.
The Client is responsible to pay the replacement cost of any lost parts or accessories, whether paid for or provided free of charge. These include but are not limited to: wired ear piece, hand or neck straps, belt clip, battery, charger, cable with plug, antenna, turn on or off/volume dials, channel switching dials, etc.
The Client is responsible for the loss, theft, damage or destruction of the rental equipment and agrees to pay the full replacement value for the rental equipment. The Client agrees to have its Rental Deposit deducted or shall authorize the replacement cost of the rental equipment to the Client’s credit/debit card or any other payment method in the sole and absolute discretion of CC.
The Client agrees to return the rental equipment in the same condition as it was delivered and to report any loss, theft, damage or destruction to the rental equipment immediately to CC.
The assessment of the damages are final with the photo proof of the damaged or missing parts. The photos which shows the damaged or missing parts will be sent to the Client via emails or Whatsapp communication channels. Dispute by the Client shall not be allowed unless there is photo proof that the item is returned to CC’s staff that it is in working condition with no damaged or missing parts.
Cancellation
A full refund will be given for all cancellations made 48 hours or more prior to the Client’s rental date, except that a finance charge of SGD 20 will applied. A full refund will be given for all cancellations made within the 48-hour window, except that an administrative charge of SGD 50 will be applied. No refund will be made for cancellation in less than 24 hours. Refunds for cancellation of booking will be refunded via the payment method as decided by CC in its sole and absolute discretion.
Liability Waiver
By accepting and using the rental equipment, the Client and any user from the Client acknowledges that the rental equipment is being used at their own risk. CC hereby makes no warranties with respect to the rental equipment, and CC hereby specifically disclaims all warranties, whether express or implied.
CC and its directors, employees, owners, contractors, third party service providers and affiliates will not be responsible for accidents, injuries or damages caused directly or indirectly by the use or misuse of the rental equipment.
The Client and any user agrees to hold harmless CC and its directors, employees, owners, contractors, third party service providers and affiliates, from any liability, injury, death, property loss or damage which may result directly or indirectly from the use of the rental equipment.
CC shall not be responsible for any loss of profits, revenues, business opportunities, goodwill, or anticipated savings, indirect or consequential loss or punitive damages suffered by the Client.
CC’s total liability arising out of or relating to this Agreement is limited to the rental fees the Client paid to use the rental equipment.
This Agreement is governed by the laws of Singapore. Any disputes will first be resolved via mediation for a period of 90 days before it is subject to the exclusive jurisdiction of the courts of Singapore.
